Coaching Agreement & Disclaimer

This agreement is effective for the private coaching program(s) by Jill Moellering FNTP, (Coach), (aka, Whole Bean Wellness, LLC) and, the Client.

The Client, can expect me, the Coach, to be honest and direct, ask straightforward, clarifying questions and use challenging techniques, and make empowering requests to help you move forward. Throughout our working relationship, the conversations will be very direct and personal. The purpose of our interaction is to hold the Client’s focused on his or her desired outcome and to coach the Client to stay clear, focused, and in action.
The Client is guaranteed confidentiality. It is important for the integrity and value of our coaching relationship that we are open and honest with each other. In this light, what we discuss will remain completely confidential. This is sacred. I will only release information about our work to others with your prior written permission, or if I am required to do so by law. Because absolute confidentiality cannot be guaranteed in electronically transmitted communication, please let me know of any preferences you have regarding use of email, phone, or fax.

The Client can expect, and is guaranteed, confidentially extended to responses shared on any questionnaire, survey, inventory, or assessment. At the completion of our coaching contract, these documents will be shredded within 60 days.
Client duties, representations and understanding of coaching

When and by purchasing any of the coaching services offered by the Coach, the Client agrees:
I, the Client, understand coaching is a relationship which is designed and defined by the Client with the Coach’s agreement, and which is based on the Client’s expressed interests, goals, and objectives. I understand the purpose of coaching is to develop and implement strategies to help me, the Client, reach personally identified goals of enhanced performance and personal satisfaction. I, the Client, understand the Coach will use discussion, questions and requests to assist me, the Client to identify personal and/or business goals; develop strategies and action plans intended to achieve such goals; and monitor progress towards implementation of the action plans. Coaching may address a wide variety of goals including specific personal projects, life balance, job performance and satisfaction, or general conditions in the client's life, business, or profession. I, the Client, understand coaching does not involve the diagnosis or treatment of mental health issues as defined by the American Psychiatric Association. I understand that coaching is not a substitute for psychotherapy, psychoanalysis, mental or physical health care, or substance abuse treatment. I, the Client, understand I am responsible for all my decisions, actions and feelings.
I, the Client, understand I am responsible for my own achievements and success and that my Coach cannot and does not promise that you, the Client, will take any specific action or attain specific goals. I, the Client, understand that I help clarify direction, make decisions, and implement action in order to achieve my goals. I understand that as the Client, I help set the agenda for my coaching, and my success will depend on my willingness to define my goals, take risks, and try new approaches. If the coaching is not working as I wish, I am empowered to inform my Coach so we can both take steps to correct the problem. Like any human endeavor, coaching can involve feelings of distress and frustration which accompany the process of change.
I, the Client, understand my Coach will assist me in developing strategies to maintain the changes I, the client, seek and that my Coach will support, encourage, teach, and help me stay "on track" toward reaching my goals by assigning homework, recommending strategies and practices. If I do not follow through with the homework assignments, or the spirit of the homework assignment, I understand I, the Client, am responsible for my decision to stay with the status quo. I understand coaching does not offer any guarantee of success.
The Client understands that the role of the Health Coach is not to provide health care, medical advise or to diagnose, treat or cure any disease, condition or other physical or mental ailment of the human body. Rather, the Coach is a mentor and guide who has been trained in holistic health and nutrition coaching to help clients reach their own health goals by helping clients devise and implement positive, sustainable lifestyle changes. The Client understands that the Coach is not acting in the capacity of a doctor, licensed dietician, psychologist or other licensed or registered professional, and that any advice given by the Coach is not meant to take the place of advice by these professionals. The Client understand the Coach is not a dietitian licensed by the state of Missouri; and that the information provided or advice given may be considered alternative care by licensed practitioners in the state of Missouri. If the Client is under the care of a healthcare professional or currently uses prescription medications, the Client should discuss any dietary changes or potential dietary supplements use with his or her doctor, and should not discontinue any prescription medications without first consulting his or her doctor. The Client has chosen to work with the Coach and understands that the information received should not be seen as medical or nursing advice and is not meant to take the place of seeing licensed health professionals. If you are in need of professional advice or medical care you must seek out the services of your own doctor or health care professional. Under no circumstances shall Jill Moellering FNTP, Whole Bean Wellness, LLC (collectively, “Company,” “we,” “our,” “us,”) or any of our representatives or contractors, be liable for any special or consequential damages that may result from the use of, the improper use of, or the inability to use the information discussed in our coaching sessions.
Personal Responsibility and Release of Health Care Related Claims
The Client acknowledges that the Client takes full responsibility for the Client’s life and well-being, as well as the lives and well-being of the Client’s family and children (where applicable), and all decisions made during and after this program. The Client expressly assumes the risks of the Program, including the risks of trying new foods or supplements, and the risks inherent in making lifestyle changes. The Client releases the Coach from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, which the Client ever had, now has or will have in the future against the Coach, arising from the Client’s past or future participation in, or otherwise with respect to, the Program, unless arising from the gross negligence of the Coach.
Financial Agreement
By signing below the Client agrees: I am responsible for the full payment of fees for the entire course of the coaching program, regardless of whether I actually attend or complete the program, once the payment is made. I recognize it is in my best interest to show up for the calls and participate fully. I understand if I miss any scheduled coaching call I will lose that call and cannot reschedule it. However, calls may be rescheduled if more than 24 hours advance notice is given.
Refund Policy: We want you to be satisfied with your purchase, but we also want you to give your best effort to apply all of the strategies in the course. I provide a 14-day money-back guarantee for the coaching program. That money-back guarantee is governed by the following terms. In order to qualify for a refund, you must submit proof that you did the work that was requested up to that point and it did not work for you. In the event that you decide your purchase was not the right decision, within 14 days of enrollment, contact me at [email protected] and let me know you’d like a refund by the 14th day at 11:59 MST. After day 14, all payments are non-refundable and you are responsible for full payment of the fees for the program regardless if you complete the program. Please note: If you opted for a payment plan and you do not request a refund within 14 days, with the required coursework at the time of your refund request, you are required by law to complete the remaining payments of your payment plan. Upon determining that you are entitled to a refund pursuant to this policy, the Company will promptly issue an instruction to its payment processor to issue the refund. The Company does not control its payment processor and will not be able to expedite any refunds. All refunds are discretionary as determined by Whole Bean Wellness, LLC. I understand all surveys, assessments, exercises, and printed materials provided by Jill Moellering FNTP, Whole Bean Wellness LLC, are the intellectual property of Jill Moellering FNTP and may not be copied, given to others, forwarded by email to others or used without written permission of Jill Moellering FNTP. By entering into this Coaching Agreement, you agree to have read and understand the foregoing provisions and agree to be bound hereby.
